{"id":329483,"date":"2024-07-03T08:05:27","date_gmt":"2024-07-03T07:05:27","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=329483"},"modified":"2024-07-03T08:05:27","modified_gmt":"2024-07-03T07:05:27","slug":"sultan-has-no-power-sokoto-govt","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2024\/07\/03\/sultan-has-no-power-sokoto-govt\/","title":{"rendered":"Sultan has no power \u2013 Sokoto govt"},"content":{"rendered":"<ul>\n<li><strong> He disclosed that the law that gives the Sultan the power to appoint anyone contravenes the 1999 constitution<\/strong>.<\/li>\n<\/ul>\n<hr \/>\n<p>The Sultan of Sokoto, Muhammad Sa\u2019ad Abubakar III, is not legally empowered to appoint district and village heads in the North-West state, the\u00a0State government has said.<\/p>\n<p>The <a href=\"https:\/\/www.withinnigeria.com\/news\/2024\/06\/28\/sokoto-troops-rescue-hostages-kill-five-terrorists\/\">Sokoto State<\/a> Attorney General, Muhammad Nasiru Binji, made this known at a public hearing at the State House of Assembly on Tuesday.<\/p>\n<p>The public hearing was on a bill for a law by the Governor Ahmed Aliyu administration to further amend the Sokoto State Local Government and Chieftaincy Law 2008.<\/p>\n<p>He disclosed that the law that gives the Sultan the power to appoint anyone contravenes the 1999 constitution.<\/p>\n<p>The justice commissioner said the executive bill sent to the Assembly seeks to correct the inconsistency.<\/p>\n<p>\u201cSection 5(2) of the constitution stipulates that the executive power to appoint in the state is vested on the governor directly or through his deputy, commissioners, or any government agent assigned by the governor.<\/p>\n<p>\u201cSo, there is no power given to the sultanate council to appoint,\u201d he said.<\/p>\n<p>\u201cSection 76(2) of the Sokoto Local Government and Chieftaincy Law gives the sultanate council the power to appoint district and village heads in the state, but with the approval of the sitting governor.\u201d<\/p>\n<p>Binji said, \u201cTo give the Sultanate Council the power to make appointments is contrary to the provisions of this section. That is why it is now presented to this honourable House to amend this section to revert to the tradition and the age-long council where the Sultanate Council recommends to the governor persons to be appointed as district heads, persons to be appointed as village heads, and not the other way round.<\/p>\n<p>\u201cIn the proposed amendment, the Sultanate Council, as in Section 76 (1) will retain the function to recommend to the governor while the power to appoint will now be with the governor.\u201d<\/p>\n<p>Meanwhile, the Sultanate Council says it&#8217;s ready to work and support the state government as well as operate with laws made by the government for the Council.<\/p>\n<p>Earlier in June, the state\u2019s High Court issued an order restraining Governor Ahmed Aliyu from sacking two of the 15 District Heads his government earlier removed from their seats.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>He disclosed that the law that gives the Sultan the power to appoint anyone contravenes the 1999 constitution.
