{"id":342371,"date":"2024-10-17T08:03:46","date_gmt":"2024-10-17T07:03:46","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=342371"},"modified":"2024-10-17T08:03:46","modified_gmt":"2024-10-17T07:03:46","slug":"agbakoba-writes-nass-demands-efcc-abolition-says-organisation-illegal","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2024\/10\/17\/agbakoba-writes-nass-demands-efcc-abolition-says-organisation-illegal\/","title":{"rendered":"Agbakoba writes NASS, demands EFCC abolition, says organisation illegal"},"content":{"rendered":"<ul>\n<li><strong>He expressed his delight and satisfaction with the fact that many states had finally taken it upon themselves to challenge the constitutionality of the EFCC<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>Former president of the Nigerian Bar Association (NBA), Mr. Olisa Agbakoba, has said the establishment of <a href=\"https:\/\/www.withinnigeria.com\/news\/2024\/10\/16\/efcc-nabs-radio-host-over-n700m-ponzi-scheme\/\">the Economic and Financial Crimes Commission (EFCC)<\/a> violates Nigerian constitution.<\/p>\n<p>Agbakoba, in two separate letters to the Senate and House of Representatives, asserted that the EFCC is an unlawful organisation.<\/p>\n<p>The certified true copy of the letters dated Oct. 14 were made available to newsmen on Wednesday in Abuja.<\/p>\n<p>The two letters were addressed separately to the Deputy Senate President, Barau Jibrin and Deputy Speaker of the House, Mr Benjamin Kalu.<\/p>\n<p>The duo double as chairman, Senate Committee on Constitution Review and Chairman, House Committee on Constitution Review respectively.<\/p>\n<p>Agbakoba said he believed that the EFCC was \u201cunconstitutionally established.\u201d<\/p>\n<p>He drew the attention of the National Assembly to constitutional issues relating to law enforcement agencies in the country and factors impeding the government\u2019s objective of abolishing corruption as stated in Section 13 of the 1999 Constitution.<\/p>\n<p>\u201cI very strongly believe the EFCC is unconstitutionally established.<\/p>\n<p>\u201cThe powers under which it was established go beyond the powers of the National Assembly. The EFCC is an unlawful organisation.\u201d<\/p>\n<p>He expressed his delight and satisfaction with the fact that many states had finally taken it upon themselves to challenge the constitutionality of the EFCC, saying, \u201cthis will put to rest the question relating to the validity of the EFCC.\u201d<\/p>\n<p>The letter to the Deputy Senate President, is titled, \u201cUrgent Legislative Attention on Constitutional Reforms Relating to Law Enforcement Agencies and Anti-Corruption Efforts\u201d.<\/p>\n<p>It reads: \u201cI commend you for the remarkable leadership you have demonstrated as Chairman, Senate Constitution Review Committee, particularly in advancing the government\u2019s reform agenda through a robust constitutional framework.<\/p>\n<p>\u201cYour efforts to strengthen the legal infrastructure underpinning the nation\u2019s development programmes are indeed commendable.<\/p>\n<p>\u201cI write to draw attention to certain constitutional issues on matters related to law enforcement agencies.<\/p>\n<p>\u201cAs you are obviously aware, the fundamental objective of the government is to abolish corruption. But from my observation, there is no harmony amongst law enforcement agencies on corruption. They all appear to be working at cross purposes.<\/p>\n<p>\u201cThis has been confirmed by the Supreme Court in so many cases.<\/p>\n<p>\u201cThe Supreme Court has consistently sanctioned the EFCC for its conduct and questioned if the EFCC can in fact validly do what it does. I will go further to say that I very strongly believe the EFCC is unconstitutionally established.<\/p>\n<p>\u201cThe powers under which it was established go beyond the powers of the National Assembly. The EFCC is an unlawful organisation.<\/p>\n<p>\u201cI am very delighted to note that many states have finally taken it upon themselves to challenge the constitutionality of the EFCC.<\/p>\n<p>\u201cThis will put to rest the question relating to the validity of the EFCC.<\/p>\n<p>\u201cWhilst we await the decision of the Supreme Court as the final court on the matter, I respectfully request that the Senate convene a public hearing to consider these constitutional issues.<\/p>\n<p>\u201cSuch a hearing would provide an invaluable platform for stakeholders to discuss the reforms needed to strengthen Nigeria\u2019s legal and institutional frameworks for law enforcement and anti-corruption.<\/p>\n<p>\u201dThis will meet the stated and laudable objective of the government to abolish corruption as stated in Section 13 of the Constitution.<\/p>\n<p>\u201cI trust that, under your capable leadership, the Senate Constitution Review Committee will give these matters urgent attention in the interest of our nation\u2019s development.<\/p>\n<p>\u201cThank you for your consideration of this important matter.
