{"id":349117,"date":"2024-12-13T20:55:52","date_gmt":"2024-12-13T19:55:52","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=349117"},"modified":"2024-12-13T20:55:52","modified_gmt":"2024-12-13T19:55:52","slug":"appeal-court-vacates-orders-blocking-release-of-rivers-allocations-says-judgment-unconstitutional","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2024\/12\/13\/appeal-court-vacates-orders-blocking-release-of-rivers-allocations-says-judgment-unconstitutional\/","title":{"rendered":"Appeal Court vacates orders blocking release of Rivers&#8217; allocations, says judgment &#8216;unconstitutional&#8217;"},"content":{"rendered":"<ul>\n<li><strong>The court averred that the lower court overreached itself and didn\u2019t have the jurisdiction to entertain the matter<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The judgement of the Abuja high court restraining the federal government from releasing the monthly financial allocation of Rivers State has been overturned.<\/p>\n<p>The Appeal Court in Abuja squashed the orders restraining the Central Bank of Nigeria, CBN, and the Accountant General of the Federation from releasing funds to the Rivers State Government on Friday.<\/p>\n<p>In its judgment, the appellate court held that the subject matter was not within the jurisdiction of the court relating to the revenue of the state.<\/p>\n<p>The judgment was delivered by three-member panel, presided by Justice Hamman Barka while ruling on the appeal of the Rivers State Government.<\/p>\n<p>The panel also set aside all the orders made by Justice Joyce Abdulmalik, stating that it was illegal and unconstitutional for her to make orders restricting Rivers State Government to receive funds due to the state from its consolidated revenue fund.<\/p>\n<p>The court averred that the lower court overreached itself and didn\u2019t have the jurisdiction to entertain the matter.<\/p>\n<p>Recall that in October, Justice Abdulmalik of the Abuja Federal High Court held that the receipt and disbursement of monthly allocations since January this year by the Rivers State Governor, Siminalayi Fubara, was a <a href=\"https:\/\/www.withinnigeria.com\/news\/2024\/10\/30\/breaking-court-orders-fg-to-withhold-monthly-allocations-to-rivers\/\">breach of the Constitution<\/a> and an aberration that must not be allowed to continue.<\/p>\n<p>The judge held that the presentation of the 2024 budget by Fubara before a four-member Rivers House of Assembly was an affront to the constitutional provision.<\/p>\n<p>Justice Abdulmalik specifically said that the governor\u2019s action was a gross violation of the 1999 Constitution.<\/p>\n<p>The judge subsequently restrained the Central Bank of Nigeria, the Accountant General of the Federation, Zenith Bank and Access Bank from further allowing Fubara to access money from the Consolidated Revenue and Federation Account<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The court averred that the lower court overreached itself and didn\u2019t have the jurisdiction to entertain the matter The judgement of the Abuja high court restraining the federal government from releasing the monthly financial allocation of Rivers State has been overturned.
