{"id":358116,"date":"2025-03-11T12:21:42","date_gmt":"2025-03-11T11:21:42","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=358116"},"modified":"2025-03-11T12:21:42","modified_gmt":"2025-03-11T11:21:42","slug":"breaking-supreme-court-affirms-aiyedatiwa-as-governor-dismisses-pdp-ajayis-bid-to-nullify-election","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2025\/03\/11\/breaking-supreme-court-affirms-aiyedatiwa-as-governor-dismisses-pdp-ajayis-bid-to-nullify-election\/","title":{"rendered":"BREAKING: Supreme Court affirms Aiyedatiwa as governor, dismisses PDP, Ajayi\u2019s bid to nullify election"},"content":{"rendered":"<ul>\n<li><strong>Ajayi had sought to annul Aiyedatiwa\u2019s victory, accusing the governor\u2019s deputy, Olayide Owolabi Adelami of forgery, impersonation, and using a false identity.<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The <a href=\"https:\/\/www.withinnigeria.com\/news\/2025\/03\/07\/rivers-crisis-why-we-reinstated-amaewhule-led-assembly-despite-fubaras-defection-claim-supreme-court\/\">Supreme Court<\/a> on Tuesday affirmed that Lucky Orimisan Aiyedatiwa was duly and legitimately elected as Ondo State governor.<\/p>\n<p>The Peoples Democratic Party, PDP, and its governorship candidate, Agboola Ajayi, had approached the apex court to challenge Aiyedatiwa\u2019s qualification to vie for the gubernatorial poll.<\/p>\n<p>But the Supreme Court, while ruling on the matter on Tuesday, dismissed the plaintiffs&#8217; appeal challenging Aiyedatiwa participation in the November 16, 2024, governorship election.<\/p>\n<p>The apex court threw out the appeal, describing it as baseless, frivolous and lacking in merit.<\/p>\n<p>The Supreme Court, In the lead judgment delivered by Justice Garba Lawal, upheld the concurrent judgments of the Federal High Court and the Court of Appeal on the disputed qualifications which dismissed the matter.<\/p>\n<p>Ajayi had sought to annul Aiyedatiwa\u2019s victory, accusing the governor\u2019s deputy, Olayide Owolabi Adelami of forgery, impersonation, and using a false identity.<\/p>\n<p>However, both the Federal High Court and the Court of Appeal dismissed Ajayi\u2019s case on procedural grounds, upholding Aiyedatiwa\u2019s win.<\/p>\n<p>Ajayi\u2019s legal challenge, filed on June 7, 2024, claimed that Adelami\u2019s eligibility was compromised due to the alleged falsification of documents.<\/p>\n<p>In the initial proceedings, the defendants, including Aiyedatiwa, Adelami, the APC, and INEC, argued that Ajayi lacked the legal standing to bring the suit and that the filing exceeded the 14-day window for such cases.<\/p>\n<p>On December 2, 2024, the Federal High Court dismissed Ajayi\u2019s case, ruling that the criminal accusations of forgery required more substantial evidence, which could not be presented through an originating summons.<\/p>\n<p>The court also deemed the petition \u201cstatute-barred\u201d as it was filed after the constitutionally mandated deadline.<\/p>\n<p>This decision was unanimously upheld by the Court of Appeal on January 18, 2025, with a N500,000 fine imposed on Ajayi.<\/p>\n<p>The latest apex court verdict has put to rest the long drawn legal battle over the Ondo State governorship poll.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ajayi had sought to annul Aiyedatiwa\u2019s victory, accusing the governor\u2019s deputy, Olayide Owolabi Adelami of forgery, impersonation, and using a false identity.
