{"id":358187,"date":"2025-03-13T07:08:38","date_gmt":"2025-03-13T06:08:38","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=358187"},"modified":"2025-03-13T07:09:35","modified_gmt":"2025-03-13T06:09:35","slug":"after-18-years-supreme-court-vacates-perpetual-injunction-stopping-probe-of-ex-gov-odili-efcc","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2025\/03\/13\/after-18-years-supreme-court-vacates-perpetual-injunction-stopping-probe-of-ex-gov-odili-efcc\/","title":{"rendered":"After 18 years, Supreme Court vacates perpetual injunction stopping probe of ex gov, Odili \u2013 EFCC"},"content":{"rendered":"<ul>\n<li><strong>The anti-graft agency stated that the impediments to probing the former governor were cleared by the recent ruling of the Supreme Court dismissing two appeals from the Rivers State government<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The Economic and Financial Crimes Commission (EFCC) says the obstacles blocking it from investigating former governor, Dr Peter Odili\u2019s tenure in Rivers state, have been removed.<\/p>\n<p>The anti-graft agency stated that the impediments to probing the former governor were cleared by the recent ruling of the Supreme Court dismissing two appeals from the Rivers State government.<\/p>\n<p>The commission disclosed the development in a statement signed by the Director of Media and Publicity of the EFCC, Dele Oyewale.<\/p>\n<p>It added that the ruling allows the commission \u201cTo investigate Dr. Odili\u2019s eight-year rule of the oil-rich state and brought to an end EFCC\u2019s long-standing legal battle to probe the administration.\u201d<\/p>\n<p>The Supreme Court had on Monday dismissed two appeals by the Rivers State government seeking to set aside the leave granted the EFCC to appeal the perpetual injunction restraining the probe of former Governor Odili.<\/p>\n<p>A five-member panel of justices led by Justice Inyang Okoro dismissed the appeals after they were withdrawn by the Attorney General of Rivers State and the speaker of the state\u2019s assembly.<\/p>\n<p>Earlier, counsel to the Rivers State government, S. A. Somiari (SAN), had informed the apex court that the appeals are seeking to set aside the leave granted to challenge an order stopping the investigation of the tenure of Peter Odili as governor of the state.<\/p>\n<p>This followed a perpetual injunction obtained in 2007 by Odili from a Federal High Court in Port-Harcourt restraining the EFCC from investigating or arresting him.<\/p>\n<p>The court order also restrained the anti-graft agency from probing the finances of the Rivers State government.<\/p>\n<p>The EFCC later applied to the Court of Appeal for leave to appeal the Federal High Court\u2019s decision out of time, an application the appellate court granted, a decision the AG, Rivers and the speaker appealed to the Supreme Court.<\/p>\n<p>While the Somiari was explaining the appeals brought to the apex court, Justice Okoro directed that they should return to the Court of Appeal to have the substantive appeal heard before coming to the Supreme Court.<\/p>\n<p>Realising the court\u2019s disposition to his case, Somiari subsequently applied to withdraw the appeal, which application was not opposed by the EFCC, Abubakar Mahmud, who led Sylvanus Tahir (SAN) and B. O. Obialo, who appeared for the other respondents.<\/p>\n<p>Ruling, Justice Okoro said: \u201cAppeal is dismissed, having been withdrawn without any objection.\u201d<\/p>\n<p>Both appeals marked
