{"id":360170,"date":"2025-07-04T13:02:41","date_gmt":"2025-07-04T12:02:41","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=360170"},"modified":"2025-07-04T13:05:16","modified_gmt":"2025-07-04T12:05:16","slug":"breaking-court-slams-senate-orders-immediate-recall-of-suspended-natasha-akpot","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2025\/07\/04\/breaking-court-slams-senate-orders-immediate-recall-of-suspended-natasha-akpot\/","title":{"rendered":"BREAKING: Court slams senate, orders immediate recall of suspended Natasha Akpoti"},"content":{"rendered":"<ul>\n<li class=\"ai-optimize-6 ai-optimize-introduction\"><strong>The court declared parts of Senate rules and privileges act as overreaching and vague on suspension duration.<\/strong><\/li>\n<li class=\"ai-optimize-7\"><b>Justice Nyako insisted punishments must not leave constituencies without representation in the legislature.<\/b><\/li>\n<\/ul>\n<hr \/>\n<p class=\"ai-optimize-8\">The Federal High Court in Abuja has ordered the immediate recall of the suspended senator representing Kogi Central, Natasha Akpoti-Uduaghan.<\/p>\n<p class=\"ai-optimize-9\">Justice Binta Nyako, who delivered the judgment on Friday, ruled that the Senate\u2019s six-month suspension of the senator was \u201cexcessive\u201d and lacked clear legal backing.<\/p>\n<p class=\"ai-optimize-10\">The court invalidated parts of Chapter 8 of the Senate Standing Rules and Section 14 of the Legislative Houses (Powers and Privileges) Act, calling them \u201coverreaching\u201d and unclear on suspension limits.<\/p>\n<p class=\"ai-optimize-11\">\u201cSince lawmakers have a total of 181 sitting days in every legislative calendar, suspending a senator for six months, equivalent to roughly 180 days, essentially deprives the constituents of representation,\u201d Justice Nyako stated.<\/p>\n<p class=\"ai-optimize-12\">She stressed that while the Senate has the constitutional authority to discipline its members, the punishment must not be so extreme as to silence the voice of a constituency.<\/p>\n<p class=\"ai-optimize-13\">\u201cA legislative house has the power to sanction its members, but such punishment must not be excessive to the point of stripping constituents of representation,\u201d the judge ruled.<\/p>\n<p class=\"ai-optimize-14\">The court, however, rejected claims that the president of the Senate, Godswill Akpabio, acted wrongly by preventing senator Akpoti-Uduaghan from speaking during plenary.<\/p>\n<p class=\"ai-optimize-15\">Justice Nyako noted that the senator was not seated at her officially designated position in the chamber when she sought to speak.<\/p>\n<p class=\"ai-optimize-16\">The court also dismissed Akpabio\u2019s objection that the judiciary had no jurisdiction to intervene in the matter.<\/p>\n<p class=\"ai-optimize-17\">\u201cThe matter is not a mere internal affair of the Senate. It touches on the rights of voters and their elected representative,\u201d the court noted.<\/p>\n<p class=\"ai-optimize-18\">Justice Nyako ruled that because the suspension affected both the senator\u2019s rights and those of her constituents, the court had every right to step in.<\/p>\n<p class=\"ai-optimize-19\">In a separate ruling delivered the same day, Justice Nyako found senator Akpoti-Uduaghan guilty of contempt of court.<\/p>\n<p class=\"ai-optimize-20\">The court said the senator violated a gag order by posting a satirical apology to the Senate president on Facebook on April 7.<\/p>\n<p class=\"ai-optimize-21\">According to the judge, the Facebook post ridiculed the court\u2019s instruction and undermined its authority.<\/p>\n<p class=\"ai-optimize-22\">Justice Nyako ordered the senator to publish a formal apology in two national newspapers and on her Facebook page within seven days.<\/p>\n<p class=\"ai-optimize-23\">The court also imposed a fine of N5 million on senator Akpoti-Uduaghan over the controversial Facebook post.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The court declared parts of Senate rules and privileges act as overreaching and vague on suspension duration.
