{"id":37928,"date":"2021-05-25T14:21:01","date_gmt":"2021-05-25T13:21:01","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=37928"},"modified":"2021-05-25T14:21:01","modified_gmt":"2021-05-25T13:21:01","slug":"changing-nigerias-constitution-wont-guarantee-a-perfect-country-says-agbakoba","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/05\/25\/changing-nigerias-constitution-wont-guarantee-a-perfect-country-says-agbakoba\/","title":{"rendered":"Changing Nigeria\u2019s constitution won\u2019t guarantee a perfect country, says Agbakoba"},"content":{"rendered":"<p>A senior advocate of Nigeria (SAN), Olisa Agbakoba has stated that a change of the 1999 constitution will not guarantee a perfect country.<\/p>\n<p>This was stated by Agbakona while speaking at the inaugural #FixPoliticsDialogues, a platform which convenes debates on national issues.<\/p>\n<p>The event tagged \u20181999 Constitution: To change or amend?\u2019 was organised by FixPolitics, a non-profit organisation, on Monday.<\/p>\n<p>Speaking at the event, <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/05\/02\/agbakoba-nigerias-problems-are-beyond-amending-the-constitution\/\">Agbakoba<\/a> said the current constitution, despite its imperfections, is not obeyed.<\/p>\n<p>He said there is no guarantee that a new constitution, no matter how perfect, will be complied with by Nigerians and those in power.<\/p>\n<p>The SAN said the process of birthing a new constitution requires strategic engagements.<\/p>\n<p>He said \u201cto force a change of constitution outside the legal framework will be considered a revolution\u201d.<\/p>\n<p>\u201cLet\u2019s not assume that a perfect constitution that we all strive for means that by a flick of the switch everything is good,\u201d he said.<\/p>\n<p>\u201cCurrently, the constitution, imperfect as it is, is not obeyed. So what is to say that the constitution we envisage will be obeyed? The answer to it is something we should reflect on carefully.<\/p>\n<p>\u201cPart of the problem we face today is the process. Because the process is faulty, Nigerians cannot claim ownership to the constitution. If there is a way to reverse that problem by overhauling the constitution and bringing in a new one, that, I think, is the ideal.\u201d<\/p>\n<p>Agbakoba said Nigerians and civil society organisations (CSOs) have the option of pushing for either an amendment or a change of the constitution.<\/p>\n<p>But he added that the process of changing the constitution may be difficult because traditional and religious institutions may not key into such a strategy.<\/p>\n<p>\u201cTactically, the space to engage in amendment is there, let\u2019s take it. Strategically, the space to overturn the constitution, if it is there, we can generate civil society momentum then let\u2019s take it. But to be quite honest with you, I don\u2019t see it,\u201d he said.<\/p>\n<p>\u201cThere is no way to expect that the present political class, whether it is APC or PDP, will surrender any iota of power unless we fight and wrestle them to the ground to get it. But my point is that is there the energy for that?<\/p>\n<p>\u201cSo as we plan towards strategic intervention in changing the dynamics of the Nigerian states and in placing a new constitution, let\u2019s not overlook the small advantages that we can get by critical engagement.\u201d<\/p>\n<p>According to Agbakoba, the constitution has 98 items of power out of which 68 items are exclusive to the federal government while the remaining 30 are shared between the federal and state governments.<\/p>\n<p>He said the challenge is the redistribution of power by reducing exclusive privileges granted to the federal government.<\/p>\n<p>The lawyer asked CSOs to operate tactically and unite to pressure the national assembly in amending the constitution for better distribution of powers.<\/p>\n<p>\u201cThe constitution does not permit a change so if we are looking for a change then let\u2019s be prepared for a revolution,\u201d he said.<\/p>\n<p>\u201cA revolution means altering the constitution in a way not envisaged by the constitution.
