{"id":63119,"date":"2021-07-27T18:29:09","date_gmt":"2021-07-27T17:29:09","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=63119"},"modified":"2021-07-27T18:29:09","modified_gmt":"2021-07-27T17:29:09","slug":"adamawa-to-court-atiku-eligible-to-run-for-president","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/07\/27\/adamawa-to-court-atiku-eligible-to-run-for-president\/","title":{"rendered":"Adamawa to court: Atiku eligible to run for president"},"content":{"rendered":"<p>The Adamawa state government on Tuesday informed a federal high court, Abuja that Atiku Abubakar, former vice-president is eligible to run for the office of the president.<\/p>\n<p>This state attorney-general of Adamawa state,\u00a0<span class=\"s1\">Afraimu<span id=\"yMail_cursorElementTracker_1627384689800\"> Jingi <\/span><\/span><span class=\"s1\">moved a <\/span><span class=\"s1\">motion on a notice seeking to be joined in a suit filed by a group against Abubakar and three others.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The group, Incorporated Trustees of Egalitarian Mission for Africa (EMA), had challenged Abubakar\u2019s eligibility to contest for president on the grounds that he is not a Nigerian citizen by birth.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The EMA joined the Peoples Democratic Party (PDP), the Independent National Electoral Commission (<a href=\"https:\/\/www.inecnigeria.org\/\" target=\"_blank\" rel=\"noopener\"><strong>INEC<\/strong><\/a>), and Abubakar Malami, the attorney-general of the federation (AGF), as co-defendants in the suit.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Jingi, through L.D. Nzadon, his lawyer, is seeking an order of the court to be joined in the matter.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">According to NAN, the lawyer described the matter as \u201ca public interest suit to ensure that the Constitution of the Federal Republic of Nigeria 1999 (as amended) is complied with in the election of the president of Nigeria\u201d.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He said the <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/07\/03\/woman-stamps-hot-iron-on-5-yr-old-stepdaughters-private-part-for-bedwetting-in-adamawa\/\">Adamawa<\/a> AG is a chief law officer of the state and that the\u00a0<\/span><span class=\"s1\">matter cannot be effectively and conclusively determined unless he is joined as a party.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Nzadon said Atiku, is a citizen of Nigeria from Adamawa and that the suit threatens the right of not just the former vice-president to contest the office of president, \u201cbut that of the citizens of Nigeria of Adamawa State origin covering 12 out of the 21 Local Government Areas in the state\u201d.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cTo disenfranchise the citizens of the 12 local government areas of Adamawa state in relation to the office of the Federal Republic of Nigeria, is to discriminate against them contrary to Section 42(1)(a), (2) of the 1999 Constitution of the Federal Republic of Nigeria (as amended),\u201d Nzadon told the court.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe government and people of Adamawa state have a greater interest in this suit than the 4th respondent (AGF).\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Since the counsel to other parties did not oppose the motion, Inyang Ekwo, the presiding judge, granted the prayer.<\/span><\/p>\n<p>The judge gave the applicant seven days to file and serve all the processes and adjourned the matter until September 27 for a hearing of the substantive suit.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Adamawa state government on Tuesday informed a federal high court, Abuja that Atiku Abubakar, former vice-president is eligible to run for the office of the president.
