{"id":74928,"date":"2021-08-25T06:45:15","date_gmt":"2021-08-25T05:45:15","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=74928"},"modified":"2021-08-25T06:45:15","modified_gmt":"2021-08-25T05:45:15","slug":"no-constitutional-basis-for-review-of-grazing-reserves-says-benue-governor","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/08\/25\/no-constitutional-basis-for-review-of-grazing-reserves-says-benue-governor\/","title":{"rendered":"No constitutional basis for review of grazing reserves, says Benue governor"},"content":{"rendered":"<p>Governor of Benue state, Samuel Ortom has stated that President Muhammadu Buhari&#8217;s decision to review grazing reserves across the country is unconstitutional.<\/p>\n<p>According to Benue governor, it is\u00a0worrying that while most states have agreed that ranching is a better way to resolve insecurity, the president has maintained his position on open grazing.<\/p>\n<p>This comment is in reaction to Buhari&#8217;s approval of the recommendations of a committee to review 368 grazing reserves across 25 states in the\u00a0country \u2014 a development that has been met with criticism.<\/p>\n<p>Popular lawyer and activist, Femi Falana had also criticised Buhari for the decision.<\/p>\n<p>Falana added that\u00a0open grazing is \u201cobsolete\u201d.<\/p>\n<p>Speaking on the development when he featured on Sunrise Daily, a Channels Television programme, on Tuesday, Ortom described the president\u2019s decision on grazing reserves as \u201cdisappointing\u201d.<\/p>\n<p>\u201cI\u2019m disappointed with the presidency. One would expect that we\u2019re in a democratic governance and the presidency would have understood this,\u201d the governor said.<\/p>\n<p>\u201cSome weeks ago, Mr. President challenged Nigerians on whether he is not ruling this country according to the rule of law. And I came out and I said \u2018Mr. President, if some people are deceiving you, let me tell you the facts on ground. You\u2019re not ruling this country according to the rule of law in some aspects\u2019. And here we are.<\/p>\n<p>\u201cDoes Mr. President not have an attorney-general to advise him on what the law says about land administration? There is a land use act enshrined in the Constitution of the federal republic of Nigeria and it amazes me for Mr. President to say that he will revive obsolete <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/08\/19\/buhari-approves-review-of-grazing-reserves-in-25-states\/\">grazing reserves<\/a> and grazing routes.<\/p>\n<p>\u201cI have had personal conversations with Mr President and his handlers. I have said \u2018Look, when we had grazing routes and grazing reserves, what was the total population? Less than 40 million. This was when it was initiated and then it was as a result of the laws governing northern Nigeria. Today, we are over 200 million people. How do you expect the same thing?\u2019 The land hasn\u2019t increased, and now, it\u2019s even less because of the ceding of Bakassi to Cameroon. Now, in 2021, you\u2019re talking about open grazing.<\/p>\n<p>\u201cHow are we going to achieve this? If Mr. President respects the law, the land use act gives governors the power to preside over land administration on behalf of the people. So, it is amazing and I am surprised to hear this coming from Mr President as if he doesn\u2019t have an attorney-general or lawyers around him to advise him.<\/p>\n<p>\u201cI think Mr President was misquoted or he did it out of error. He should come out to apologise to Nigerians.
