{"id":79407,"date":"2021-09-06T19:28:27","date_gmt":"2021-09-06T18:28:27","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=79407"},"modified":"2021-09-06T21:01:41","modified_gmt":"2021-09-06T20:01:41","slug":"nnamdi-kanus-lawyer-sues-dss-over-rights-violation-demands-n50m-as-damages","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/09\/06\/nnamdi-kanus-lawyer-sues-dss-over-rights-violation-demands-n50m-as-damages\/","title":{"rendered":"Nnamdi Kanu\u2019s lawyer sues DSS over \u2018rights violation\u2019, demands N50m as damages"},"content":{"rendered":"<p>A member of the legal team representing Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, Maxwell Opara has filed a suit against the Department of State Services (DSS) over alleged violation of his rights.<\/p>\n<p>According to the suit marked FHC\/ABJ\/CS\/1018\/2021, which was filed on Monday, Opara alleged that his fundamental human rights were violated during a visit to Kanu in DSS custody on August 30.<\/p>\n<p>Recall that Nnamdi Kanu has been in DSS custody since his arrest and extradition to Nigeria.<\/p>\n<p>Kanu is on trial for <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/07\/26\/court-adjourns-seating-over-agba-jalingos-terrorism-treasonable-felony-trial\/\">treasonable felony<\/a>.<\/p>\n<p>According to Opara,\u00a0DSS operatives \u201cforced him\u201d to remove his outfit, including his \u201cmedicated eye-glasses, and his wedding ring\u201d, while he was being searched.<\/p>\n<p>He prayed the court for \u201ca declaration that the Respondents, whilst in the execution of their duties, must respect the fundamental rights of citizens and accordingly abide by the provisions of Chapter 4 of the 1999 Constitution of the Federal Republic of Nigeria as amended and the provisions of the Africa Charter on Human and Peoples Rights (Ratification and Enforcement) Act\u201d.<\/p>\n<p>Opara is also seeking an order from the court declaring \u201cthat the actions of the men, operatives and officers under the command commission of the Respondents on the 30th of August, 2021 during the Applicant\u2019s visit to see his client in their detention facility, wherefore they commandeered the Applicant to a particular room within their facility; for purposes of alleged bodily search, wherein they forced him to remove his medicated eye-glasses, wedding ring, belt, jacket and shoes and accordingly left him shabbily dressed, harassed, intimidated and humiliated, amounts to a gross violation of the Applicant\u2019s right to dignity of human person as guaranteed under Sections 34 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and Article 5 of the African Charter on Human and People Rights (Ratification and enforcement) Act Cap A9 Vol. 1 LFN\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A member of the legal team representing Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, Maxwell Opara has filed a suit against the Department of State Services (DSS) over alleged violation of his rights.
