{"id":79526,"date":"2021-09-07T05:42:00","date_gmt":"2021-09-07T04:42:00","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=79526"},"modified":"2021-09-07T05:42:00","modified_gmt":"2021-09-07T04:42:00","slug":"how-conflicting-court-orders-make-our-work-difficult-inec","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/09\/07\/how-conflicting-court-orders-make-our-work-difficult-inec\/","title":{"rendered":"How conflicting court orders make our work difficult &#8211; INEC"},"content":{"rendered":"<p>Chairman of the Independent National Electoral Commission (INEC), Mahmood Yakubu has stated that conflicting court orders on political matters are making the commission&#8217;s work difficult.<\/p>\n<p>Recently, multiple court orders have been issued bordering on the leadership crisis of the Peoples Democratic Party (PDP) as well as candidates<span class=\"s1\">\u00a0for the Anambra governorship election scheduled for November.<\/span><\/p>\n<p>Following this development, the chief justice of Nigeria (CJN), <strong><a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/08\/30\/cjn-summons-six-chief-judges-over-conflicting-court-orders\/\">Ibrahim Muhammad<\/a><\/strong> summoned six chief judges over conflicting orders issued on their courts.<\/p>\n<p>Yakubu while addressing political parties on Monday during the<span class=\"s1\"> commission\u2019s quarterly meeting said such litigations affect the credibility and transparency of the electoral process.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He, however, appreciated the CJN and Nigerian Bar Association (NBA) for steps taken on the recent multiple court orders.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cI am aware that some of the cases are still in court and therefore sub judice. I must say that some of the decided cases are making our work difficult and we have been crying out loud for a long time. In particular, some pre-election <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/07\/30\/apc-threatens-sanctions-against-parallel-congresses\/\">litigations<\/a> relating to the nomination of candidates for elections were not determined until after the elections,\u201d Yakubu said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cConsequently, in some instances, political parties were declared winners without candidates to immediately receive the certificates of return on account of protracted and conflicting litigations or where courts, rather than votes, determine winners of elections. This situation is compounded by cases on the leadership of political parties, thereby making the exercise of our regulatory responsibilities difficult.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIt appears that in a number of electoral cases in Nigeria today, the settled law is now unsettled and the time-honoured principle of stare decisis does not seem to matter any longer. What is most disconcerting for us is that the more INEC strives to improve the credibility and transparency of our electoral process, the more extraneous obstacles are put in our way through litigations.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cHowever, the commission appreciates the recent statement by his lordship, the chief justice of Nigeria, as well as the strongly-worded concern by the Nigerian Bar Association.
