{"id":79585,"date":"2021-09-07T08:17:37","date_gmt":"2021-09-07T07:17:37","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=79585"},"modified":"2021-09-07T08:17:37","modified_gmt":"2021-09-07T07:17:37","slug":"firs-speaks-on-vat-judgement-asks-taxpayers-to-maintain-status-quo","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/09\/07\/firs-speaks-on-vat-judgement-asks-taxpayers-to-maintain-status-quo\/","title":{"rendered":"FIRS speaks on VAT judgement, asks taxpayers to maintain status quo"},"content":{"rendered":"<p>The Federal Inland Revenue Service (FIRS) has called on taxpayers not to panic over the recent court ruling by the federal high court sitting in Port Harcourt.<\/p>\n<p>Recall that the court on Monday dismissed FIRS&#8217; motion for stay of execution of the earlier judgement directing Rivers state to take charge of value-added tax (VAT) collection.<\/p>\n<p>The agency stated that \u201cuntil the court of appeal, or even the supreme court, determines the matter, taxpayers are required to continue to comply with their value-added tax (VAT) obligations within the status quo framework.\u201d<\/p>\n<p>This was contained in a statement released on Monday by the special assistant on media and communication to the chairman of FIRS, Johannes Oluwatobi Wojuola.<\/p>\n<p>\u201cThe FIRS having lodged, in the Court of Appeal, both an appeal against the decision of the Federal High Court sitting in Rivers State in Suit No. FHC\/PH\/CS\/149\/2020, Attorney General of Rivers State Vs Federal Inland Revenue Service, and an injunction pending appeal of the said judgement assures taxpayers that there was no cause for alarm,\u201d the statement reads.<\/p>\n<p>\u201cThe Federal High Court ruling should not breed any confusion as to the obligations of <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/08\/23\/rivers-judgement-continue-to-pay-vat-to-us-firs-tells-taxpayers\/\">taxpayers<\/a>. Taxpayers must continue to comply with the Value Added Tax Act pending the final determination of the appeal.<\/p>\n<p>\u201cTaxpayers must continue to honour their tax obligations under the VAT Act. Failure to do this would put them on a collision course with the law.<\/p>\n<p>\u201cFor the avoidance of doubt, records of appeal have been transmitted to the appellate court. The Service is confident that, given the extant laws, the arguments and case put forward, it will earn a favoured judgment at the appellate court.\u201d<\/p>\n<p>Meanwhile, Nyesom Wike, Rivers state governor, has directed the state\u2019s Internal Revenue Service (RIRS)\u00a0to fully implement and enforce the collection of value-added tax(VAT).<\/p>\n<p>The Lagos house of assembly also\u00a0passed the first and second reading\u00a0of a bill seeking to empower the state government to collect value-added tax (VAT).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Federal Inland Revenue Service (FIRS) has called on taxpayers not to panic over the recent court ruling by the federal high court sitting in Port Harcourt.
