{"id":85490,"date":"2021-09-23T04:43:33","date_gmt":"2021-09-23T03:43:33","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=85490"},"modified":"2021-09-23T06:23:54","modified_gmt":"2021-09-23T05:23:54","slug":"caregiver-allegedly-rapes-boss-14-year-old-granddaughter-in-abuja","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/09\/23\/caregiver-allegedly-rapes-boss-14-year-old-granddaughter-in-abuja\/","title":{"rendered":"&#8216;Blood stain&#8217; tendered as court evidence against Abuja Caregiver who raped boss\u2019 granddaughter in Abuja"},"content":{"rendered":"<p>A 21-year-old caregiver, Godwin Onuminya, has been arraigned before FCT High Court, Kubwa for allegedly raping his boss\u2019 14-year-old granddaughter.<\/p>\n<p>An Investigating Police Officer, ASP Mary Okoi, told the court that Onuminya, who is charged with one count of rape confessed to committing the crime.<\/p>\n<p>Okoi, attached to the State Criminal Investigation Department, FCT Command, made the allegation while being led in evidence by the Prosecution Counsel, Adama Musa.<\/p>\n<p>According to News Agency of Nigeria, Okoi said a case of <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/09\/22\/15-year-old-girl-narrates-how-her-neighbour-drugged-and-raped-her\/\" target=\"_blank\" rel=\"noopener\">rape<\/a> was transferred from the Kubwa Divisional Police Headquarters and referred to her department where the defendant was rearrested on November 8, 2019.<\/p>\n<p>\u201cThe statement of the complainants, witnesses and the 14-year-old girl were recorded.<\/p>\n<p>\u201cThe statement of the defendant was also recorded under caution, in the presence of his elder brother who is a policeman.<\/p>\n<p>\u201cThe defendant confessed to committing the crime in his statement and afterward we proceeded to the crime scene where we recovered the exhibits which are the 14-year-old girl\u2019s pants and pink trouser <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/07\/02\/ekiti-man-sentenced-to-life-imprisonment-for-raping-undergraduate-with-charms\/\" target=\"_blank\" rel=\"noopener\">stained with blood<\/a>,\u201d Okoi said.<\/p>\n<p>She said that the exhibits were tied in a leather bag and she proceeded to the Police hospital where the girl was examined.<\/p>\n<p>\u201cThe doctor saw the injuries sustained by the victim and issued a medical report, which was sent to the Kubwa Police Station and forwarded to my station and attached to the case file.<\/p>\n<p>\u201cIn the course of investigations, I discovered that the girl <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/09\/21\/plateau-students-faint-as-security-operatives-fire-tear-gas-during-strikes-protest\/\" target=\"_blank\" rel=\"noopener\">fainted<\/a> on the day she was raped and the defendant confessed that he overpowered her and raped her,\u201d she said.<\/p>\n<p>The defendant\u2019s statement and the blood-stained trousers and underwear were tendered as exhibits in court.<\/p>\n<p>The defence counsel, Abu Adaweno, however, objected to it, saying the defendant\u2019s statement was not voluntarily made, adding that there was no lawyer present. He, therefore, applied for a trial-within-trial .<\/p>\n<p>Justice Kezziah Ogbonnaya adjourned the matter until November 8 for a trial-within-trial (a trial-within-trial is a mini trial within the context of the main trial).<\/p>\n<p>Trial-within-trial is a procedure in criminal law wherein the confessional statement of an accused person is subjected to trial scrutiny so as to determine whether or not the statement was freely and voluntarily made by the accused person to the Police.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A 21-year-old caregiver, Godwin Onuminya, has been arraigned before FCT High Court, Kubwa for allegedly raping his boss\u2019 14-year-old granddaughter.
