{"id":87906,"date":"2021-09-30T05:40:55","date_gmt":"2021-09-30T04:40:55","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=87906"},"modified":"2021-09-30T05:53:28","modified_gmt":"2021-09-30T04:53:28","slug":"major-sues-nigerian-army-bank-n2bn-over-alleged-torture-frozen-account","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/09\/30\/major-sues-nigerian-army-bank-n2bn-over-alleged-torture-frozen-account\/","title":{"rendered":"Major sues Nigerian Army, bank N2bn over alleged torture, frozen account"},"content":{"rendered":"<p>One Major Akeem Oseni, has sued the Nigerian Army N2 billion over the alleged torture he suffered for 10 months during his detention at the Military Police Headquarters in the Federal Capital Territory, Abuja.<\/p>\n<p>Oseni also joined First City Monument Bank Plc in the suit for allegedly placing a post-no-debit on his account without a court order.<\/p>\n<p>According to PUNCH, Oseni was held in the detention centre from February 11 to December 17, 2020 over the death of a junior colleague, Lance Corporal Benjamin Collins.<\/p>\n<p>The <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/09\/20\/army-reveals-what-made-boko-haram-insurgents-surrender\/\" target=\"_blank\" rel=\"noopener\">Army<\/a> allegedly subjected him to dehumanising treatments by chaining his hands and legs while in detention at the facility.<\/p>\n<p>The embattled officer, who was tried and jailed for 10 years by the court-martial was later transferred from the detention facility to the Kuje Custodial Centre after his sentence was confirmed by the Army council.<\/p>\n<p>His elder brother, Saheed, said military officer\u2019s ordeal started when a former Chief of Staff, Army Headquarters Garrison ordered him and three other officers to drill the late Collins for attempting a <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/09\/13\/update-kogi-govt-speaks-on-jailbreak-at-kabba-prison\/\" target=\"_blank\" rel=\"noopener\">jailbreak<\/a>.<\/p>\n<p>He said, \u201cMy brother narrated all that transpired when I visited him at Kuje prison and it is quite unfortunate that he is suffering because he executed an order from a superior officer.<\/p>\n<p>\u201cAkeem and three other officers, (Major O.U. Osawe; Captain S. Amosu, and Lieutenant Dogary), were asked to drill a junior officer who attempted a jailbreak.<\/p>\n<p>\u201cMy brother supervised as one of the officers drilled the lance corporal. Unfortunately, the guy got sick and was taken to a hospital where he died.<\/p>\n<p>\u201cHe and the other officers were court-martialed and sentenced to 10 years\u2019 imprisonment each. My brother is currently serving the term, but has since lodged an appeal against his conviction.\u201d<\/p>\n<p>Saheed, however, lamented that the other officers had been acquitted and freed by the Army.<\/p>\n<p>\u201cThis is suspicious as we feel somebody somewhere is using influence to oppress my brother who, alongside the other freed officers, carried out an official duty that unfortunately led to the soldier\u2019s death.<\/p>\n<p>\u201cBecause of this incident, his wife and children were thrown into hardship as his FCMB account was placed on post-no-debit. My brother also said the Army ransacked his residence and carted away money and valuables worth millions of naira,\u201d he added.<\/p>\n<p>PUNCH reported that one of the legal documents filed in court by human rights lawyer, Mike Ozekhome read in part, \u201cThat the act of the 2nd respondent (First City Monument Bank Plc) placing the personal account of the applicant (Akeem Oseni) domiciled with FCMB, with account number: 2656152013, on a post-no-debit from February 2020, till date on the directives of the Nigerian Army, without a valid court order or affording him adequate time and facility to be heard is illegal, wrongful, unlawful and constitutes a blatant violation of the applicants\u2019 fundamental rights to fair hearing.\u201d<\/p>\n<p>Reacting, the Army spokesman, Onyema Nwachukwu, said, \u201cMajor Akeem Oseni was court-martialed for the <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/09\/30\/chike-akunyilis-son-narrates-how-his-dad-was-murdered\/\" target=\"_blank\" rel=\"noopener\">murder<\/a> of a soldier. He even escaped from custody when he was arrested for the offence and was rearrested in Benin Republic.<\/p>\n<p>\u201cHe was sentenced to 10 years\u2019 <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/09\/22\/man-sentenced-to-28-years-imprisonment-for-killing-female-lawyer-in-lagos-hotel-room\/\" target=\"_blank\" rel=\"noopener\">imprisonment<\/a> by the court-martial and this was confirmed by the Army council last year. I understand he has appealed and the matter is in court. Hence, it will be sub judice to comment on the issue.
