President Tinubu’s Directive on Satellite Data Access Is Misguided

Closely examining numerous ministries, departments, and agencies across the country reveals an alarming trend of overlapping functions and mandates. Despite the promise of a new administration focused on efficiency and cooperation, recent events suggest that duplicative functions persist. Many are now urging the president to take immediate action to address this concern.

The recent directive from the president instructing all governmental agencies to obtain satellite data from the National Population Commission (NPC) raises significant legal and operational questions. This directive appears to violate the established acts governing the roles and responsibilities of the NPC and the National Space Research and Development Agency (NASRDA).

A thorough review of the enabling legislation for NASRDA and NPC demonstrates that NASRDA is legally designated as the sole custodian of satellite data over Nigeria’s territories. Any other agency performing this function is in direct contravention of the law. Section 6(k) of the NASRDA Act of 2010 explicitly states that NASRDA is the designated repository for all satellite data over Nigeria, and all collaborations and consultations regarding space data matters must involve the agency.

Recent observations indicate that NPC has acquired satellite images and data over Nigeria without involving NASRDA, a clear violation of established laws. Such actions must be halted immediately to ensure compliance with legal requirements.

We have confidence in President Asiwaju Bola Tinubu’s commitment to upholding the rule of law and strengthening national institutions. However, he may have been misinformed regarding the appropriate procedures for accessing satellite data.

There are several concerns regarding this directive, particularly the NPC’s lack of sufficient manpower and expertise to manage satellite data effectively. Therefore, it is recommended that the president reconsider this directive and ensure compliance with existing laws and regulations.
