  • BATN responded to the $110 million fine from FCCPC, clarifying payment had been made, referencing the investigation in its reports
  • In December 2022, a consent order was reached, resolving the FCCPC investigation; BATN emphasized cooperation and commitment to Nigerian laws

British American Tobacco Nigeria (BATN) has issued a formal response to the $110 million fine imposed on it by the Federal Competition and Consumer Protection Commission (FCCPC) of the Nigerian government. The FCCPC had disclosed the fine, indicating that it resulted from an active investigation initiated on August 28, 2020, into BATN and its affiliates.

In response, BATN clarified in a statement that it had already made the payment in connection with the penalty. The company acknowledged the investigation mentioned by the FCCPC in its year-end 2022 Annual Report and reiterated in its Half-Year Report for the six months ending June 30, 2023.

According to BATN, in December 2022, the FCCPC entered into a consent order, concluding the mentioned investigation and related proceedings. The statement confirmed that British American Tobacco (Nigeria) Limited and British American Tobacco Marketing (Nigeria) Limited had made payments to settle the penalty.

BATN also recognized the monitorship and awareness campaigns mentioned by the FCCPC and stated that it had fully cooperated with the service providers appointed by the FCCPC. The company affirmed its commitment to operating in compliance with the laws of Nigeria.
