For seven days, a Massachusetts jury sat behind closed doors trying to decide whether Lindsay Clancy was criminally responsible for killing her three children. On Friday, September 4, 2026, they told Judge William Sullivan what many had started to suspect: they could not agree. Eleven jurors stood on one side, one on the other, and no amount of further deliberation was going to close that gap.
Judge Sullivan declared a mistrial. Within minutes, “mistrial” became one of the most searched legal terms in the United States, as people who had followed the trial for five weeks tried to make sense of what it actually meant, and whether Clancy had just been let off the hook.
She hasn’t been. Here is what a mistrial really means, why it happens, and what it means specifically for the case that has gripped the country.
What Does a Mistrial Mean, in Plain English?
A mistrial is a trial that ends without a verdict. It is not an acquittal, and it is not a conviction. Legally, it’s as if the trial never reached a conclusion at all, the case is left open, the charges remain in place, and prosecutors are usually free to try the defendant again in front of a new jury.
The most common reason for a mistrial, and the one at the center of the Clancy case, is a hung jury: a jury so divided that it cannot reach the unanimous verdict that criminal trials require. Judges don’t declare a hung jury lightly. They typically send jurors back to deliberate more than once, sometimes issuing what’s known as an Allen charge, an instruction urging holdout jurors to reconsider their position without abandoning their honest conscience. Only when a judge is convinced that further deliberation would be pointless does a mistrial get declared.
Mistrials can also be triggered by other events entirely unrelated to jury deadlock: a juror’s misconduct, a prosecutor’s improper comment in front of the jury, the sudden death or illness of someone central to the trial, or evidence that should never have been admitted. But a hung jury is by far the most familiar version, and it’s exactly what happened in Plymouth Superior Court.
The Deadlock That Ended the Clancy Trial
Lindsay Clancy, 36, was on trial for the deaths of her three young children, five-year-old Cora, three-year-old Dawson, and eight-month-old Callan, who were found dead at the family’s Duxbury home in January 2023. Prosecutors said Clancy strangled her children before attempting to take her own life. Her defense argued she was in the grip of severe postpartum psychosis and lacked the criminal responsibility to be held legally culpable, a defense that pulled maternal mental health into the national conversation in a way few criminal trials ever do.
The trial itself ran for roughly five weeks and featured more than 80 witnesses. Jurors then spent about 38 hours spread across seven days trying to reach a unanimous decision. Twice, Judge Sullivan sent them back to keep working. Both times, they returned with the same message. The final note, read aloud in court, said the jury was reporting “with a heavy heart” that it could not come to a unanimous decision and would not be able to.
Behind the scenes, the divide had already spilled into public view. Defense attorney Kevin Reddington argued that the single holdout juror had effectively refused to follow the judge’s legal instructions, and asked Sullivan to question that juror further or remove them from the panel. Sullivan declined, saying there was no indication the juror had refused to deliberate — only that they disagreed. Reddington took the fight to the Massachusetts Supreme Judicial Court in an emergency appeal on the morning of September 4. The state’s highest court denied it that same afternoon, clearing the way for Sullivan to make the mistrial official.
Is Lindsay Clancy Free? What Happens Next
A mistrial is not a finish line. Because jeopardy never technically “attached” to a completed verdict, the constitutional protection against double jeopardy does not apply, and prosecutors are legally entitled to retry Clancy on the same charges. Plymouth County District Attorney Timothy Cruz made clear outside the courthouse that he stands behind the case, telling reporters that “children were murdered, and it’s our job to seek justice.” He stopped short, however, of confirming an immediate decision to retry her.
Judge Sullivan has already signaled he wants a second trial to happen relatively soon, “sooner rather than later,” in his own words, rather than let the case drift for months. He has set a status conference for September 29, 2026, when the court will map out scheduling. Reddington, for his part, said he’d like the retrial to begin as early as the following week, though that timeline will depend on court availability and the schedules of both legal teams.
There is a third possibility that often follows a hung jury in serious cases: negotiation. Criminal defense attorneys who’ve watched the case, including Boston-based lawyer Peter Elikann, note that prosecutors sometimes respond to a deadlocked jury by opening the door to a plea deal on reduced charges rather than gambling on a second trial with an uncertain outcome. Whether that happens here is unclear. Cruz’s public comments so far suggest he isn’t inclined to soften the charges, but plea negotiations often happen quietly, long before either side confirms them publicly.
Clancy remains in custody. Nothing about her legal status changed with the mistrial beyond the fact that the first jury’s work is now void, and the case effectively resets to before a verdict was possible.
The mistrial hasn’t cooled the intense public interest in the case , if anything, it’s added fuel to it. The trial had already become a flashpoint for debate around postpartum psychosis, criminal responsibility, and how the justice system should treat mothers who kill while experiencing a documented mental health crisis. Reddington’s defense strategy leaned heavily into that framing, and it appears to have persuaded at least one juror enough to hold the line against eleven others.
On the other side, Patrick Clancy, the children’s father and Lindsay’s ex-husband, issued a statement through his attorney saying he was grateful for the jury’s effort but devastated at the prospect of reliving the case in a second trial , a pain he described as something “from which he will never recover.” Even the White House weighed in, with President Trump telling reporters he had been following the case and calling it a “horrible tragedy.”
For now, the only certainty is procedural: no verdict exists, the charges stand, and Massachusetts prosecutors have to decide, within the next few weeks, whether to put Lindsay Clancy in front of a new jury or seek another path to resolution. Whatever they choose, the retrial, if it happens, will almost certainly reopen every argument that split this jury down the middle.
