- But the court held that all the appellants failed to prove the allegation of non-compliance with the Electoral Act.
The appeal filed by Patrick Tonye-Cole, the All Progressives Congress’ (APC) candidate for governor of Rivers State, against the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP), and Governor Siminalayi Fubara, will be heard by the Supreme Court of Abuja on Monday, and a decision may be rendered.
Tonye-Cole is hoping that Fubara resigned from his position as the state’s accountant general before the date set by the Electoral Act and the constitution.
Fubara was therefore ineligible to run for office, much less be proclaimed the victor by INEC, according to Tonye-Cole.
This, among others pleas of the APC candidate, is what the apex court will consider later today.
This is as every electoral legal matter is expected to end tomorrow, the 16th of January, 2024.
