Rivers Guber: Supreme Court To Hear Tonye-Cole’s Case Against Fubara Today

The APC candidate also argued that Fubara was not qualified to contest or even to be declared winner of the election.

  • The APC candidate had requested that the court order INEC to declare him winner of the March governorship election in Rivers.
  • But the court held that all the appellants failed to prove the allegation of non-compliance with the Electoral Act.

The appeal filed by Patrick Tonye-Cole, the All Progressives Congress’ (APC) candidate for governor of Rivers State, against the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP), and Governor Siminalayi Fubara, will be heard by the Supreme Court of Abuja on Monday, and a decision may be rendered.

Tonye-Cole is hoping that Fubara resigned from his position as the state’s accountant general before the date set by the Electoral Act and the constitution.

Fubara was therefore ineligible to run for office, much less be proclaimed the victor by INEC, according to Tonye-Cole.

This, among others pleas of the APC candidate, is what the apex court will consider later today.
