Court of Appeal dismisses Abba Kyari’s appeal to quash drug charges

  • Justice Adebukol Banjoko, delivering the lead judgement, upheld the trial court’s findings from March 22, 2023, and directed the continuation of the trial at the Federal High Court

The Court of Appeal in Abuja has dismissed an appeal by suspended Deputy Commissioner of Police Abba Kyari to quash his drug trafficking charges.

A three-member panel of the appellate court ruled that Kyari’s appeal lacked merit.

Justice Adebukol Banjoko, delivering the lead judgement, upheld the trial court’s findings from March 22, 2023, and directed the continuation of the trial at the Federal High Court.

“The appeal is found unmeritorious and is accordingly dismissed,” said Banjoko.

Justices Peter Obiora and Okon Abang concurred with the judgement.

Kyari, along with four team members, faces eight counts of drug trafficking. He had argued that the charges were premature, claiming the National Drug Law Enforcement Agency (NDLEA) should have allowed police investigations and disciplinary actions to conclude first.

Presiding Judge Emeka Nwite dismissed his application.
